When I talk with lawyers about their experiences in mediation and negotiation, they tell me that they worry about settling heir clients’ cases short. Plaintiffs worry about settling their cases for too little money and defendants worry about paying too much; And those anxieties often lead negotiators to agonize over every proposal, to make moves that send mixed messages about where the case should settle, and to needlessly prolong negotiations.

At the end of the day, whether they’ve settled the case or not, they all worry to some degree that “they’ve left money on the table”. Sound familiar?

We all know something about negotiation. We negotiate every day of our lives. Some of us, lawyers and insurance claims representatives to name a few, negotiate for a living. But how many of us have ever had any real training in the art and science of negotiation? Until recently, there wasn’t a law school in the country that offered a course in negotiation theory and practice.

Well, that has changed, and my goal for this 6-hour CLE is to fill in the gaps in your understanding about negotiation and to help you, as one lawyer said two years ago, “learn what I don’t know about negotiations”.

There’s a lot of literature available now that can be applied in both theory and practice to the every-day work of the practicing lawyer, claims representative, banker, CEO, contract negotiator, real estate agent and ordinary businessperson.
